1.1. This KChat Terms & Conditions (“T&C”) includes terms, conditions, personal data processing notices, and regulations related to the use of security services, including all existing and future features to be developed of KChat (“Product”).
1.2. To use any KChat services, Users must agree to all terms and conditions of this T&C. In case Users do not agree with any terms, Users must immediately cease using the Product.
1.3. By clicking “Agree” to the KChat Terms of Use T&C, Users acknowledge that they have read, understood, been explained, and committed to fully comply with all principles, regulations, and applicable policies stated in this T&C. In case of conflicts between this T&C and related policies, the terms of this T&C shall take precedence.
1.4. Within the scope permitted by law, in case Users do not agree with part or all of the terms of this T&C, we have the right to restrict, suspend, or terminate the provision of the Product to Users due to lack of necessary information or data.
1.5. We reserve the right to modify and supplement any and all content of this T&C at any time without prior notice or User consent.
“We”: Refers to KChat Team.
“User”; “You”; “Data Subject”: Refers to any individual or entity using the KChat application, whose personal data is processed according to this T&C and related policies.
“Product”: All services and features provided through the KChat application.
“Account”: Login data that Users use to access and use the KChat application.
“Device”: Physical hardware used to access the Account for the purpose of using the Product.
“User Content”: Includes text, images, audio, and all other forms of expression uploaded by Users to the KChat system according to the T&C’s regulations.
3.1. To use KChat Product, Users must register an Account. Users commit that Account usage must fully comply with the T&C’s regulations, while providing accurate and complete registration/update information. We are not responsible if the provided information is inaccurate and affects Users’ rights.
3.2. Users understand and agree that, to improve system resource management efficiency, in case Users do not log in and use their Account within 45 days from the last login, we have the right (but not obligation) to delete the entire Account along with all related User Data. If Users wish to use the Product again, they will need to register a new Account.
3.3. Users are responsible for all activities, including legal responsibility, performed through their Account during the use of the KChat Product. In case of risks due to Account information or password exposure, we are not responsible for compensating Users.
4.1. Copying, editing, reproducing, or developing new products based on the KChat Product platform.
4.2. Selling, transferring, re-licensing, disclosing, or transferring part or all of the Product’s data to any third party, except when such data belongs to the User’s legal ownership.
4.3. Moving, removing, or changing any legal notices, ownership marks, or copyright statements on the Product.
4.4. Redesigning, compiling, disassembling, editing, or reverse engineering the structure of the KChat Product or existing content on the system.
4.5. Illegally changing or canceling the Product’s original state.
4.6. Exploiting the KChat Product to perform actions harmful to our information security or cybersecurity, including unauthorized access to servers, deleting, editing, or adding information, spreading malware, viruses to damage the system.
4.7. Logging in and using KChat Product through software or systems of third parties not developed or licensed by us.
4.8. Using, selling, lending, copying, editing, connecting, translating, publishing, or announcing information related to the KChat Product; building copycat websites or fake websites to publish information or develop derivative products.
4.9. Exploiting the KChat Product to upload, transfer, transmit, or store content that violates laws, violates good customs and traditions; causes division, racial discrimination; or offends the legitimate rights of individuals and organizations.
4.10. Exploiting the KChat Product to use, upload, transfer, transmit, or store content that violates intellectual property rights, trade secrets, or legal rights of third parties.
4.11. Using the KChat Product for illegal activities, serving illegal purposes, or causing harassment, reducing the experience of other Users, including but not limited to accessing and spreading illegal information, harmful cultural products.
4.12. Exploiting any feature for purposes of violating laws, contrary to ethics, or good customs and traditions.
4.13. Violating current legal regulations and rules related to the use of the KChat Product.
By logging in and using the KChat product, Users agree and commit that we have the right to apply technical measures to collect and process data related to Users’ Accounts (“Account Information”). We collect and process both basic personal information and sensitive personal data of Users as follows:
5.1. Basic personal data provided by Users
(i) Identification information: Personal information provided by Users when creating Accounts and during product use, including phone number, email address.
(ii) User-generated content: Including survey information filled by Users through the product interface.
5.2. Basic personal data actively collected by us
(i) Application, device, and network information: Including data about operating system, version, default language, signal quality, cookie information, IP address, energy level, interaction data, connection status, incident information, performance, browser data, and network-related information.
(ii) Account activities: Recording the time, frequency of activities on the product and activities Users performs through their Account, along with incident reports.
(iii) Information updated through request forms: When Users update contact or personal information through request forms to KChat.
5.3. Purposes of collecting and using Account Information
We collect Account Information to provide stable, secure services and enhance user experience. Specifically:
(i) Product provision: Using Account Information to register and authenticate Users, serving functions as requested on the product.
(ii) Research and development: Analyzing trends, building statistics, assessing risks and fixing technical issues, while detecting fraud to improve product features.
(iii) Product security assurance: Using Account Information to protect Users from information security risks and prevent abuse of the product for illegal purposes.
(iv) User communication: Serving communication purposes, responding to requests and consulting through provided contact information.
(v) Legal compliance: Meeting legal procedures and requirements from competent authorities according to current law regulations.
(vi) Fraud prevention: Preventing fraud, intrusion, account theft, or identity impersonation of Users.
(vii) Prevention of illegal activities: Using Account Information to prevent illegal activities.
(viii) Other business purposes: Implementing other purposes related to the product’s business activities that we deem appropriate at each time.
5.4. Data sharing
(i) Internal sharing: We may share User information with member companies, subsidiaries, or affiliated partners for one or more stated purposes.
(ii) Third-party sharing with permission: Users’ Account Information may be shared with third parties when permitted or requested by Users, to support the provision of goods, services, or other benefits to Users.
(iii) Login support for third-party services: The KChat Product may provide login support features for third-party services. When Users agree, before logging into these services, we will share some of the User’s account information (according to granted permissions) to facilitate the registration and usage process.
(iv) Sharing according to legal regulations: In other cases, data sharing will be performed according to legal regulations.
(v) Protection of shared information: When sharing information according to the above purposes, we require data recipients to comply with guidelines, regulations, and information protection measures according to legal regulations.
5.5. Account Information storage period
Users’ Account Information will be stored for the time necessary to provide the Product according to this T&C or according to current legal regulations.
5.6. Updating, Modifying, and Deleting Account Information
(i) Through product interface: Users can log into their Account to access features for modifying, deleting Account, or withdrawing consent for information processing through the KChat product interface.
(ii) Written requests: Additionally, Users can send written requests to KChat to request updates, modifications, or deletion of account information.
(iii) Canceling collection rights: In case Users do not agree to continue allowing the collection and use of Account Information, Users can actively disable access rights on the product or contact us directly to implement related requests.
(iv) Processing method: All requests related to Data Subject rights will be recorded through request forms to KChat (address stated in the Contact section of the T&C). We will verify Users’ identity to protect Users’ rights before processing requests.
(v) Implementation scope: We only implement requests for Account Information that Users have authorized for processing according to Article 5 of this T&C.
6.1. Data processing in emergency situations: In emergency cases, to protect the life and health of Users or others, immediate processing of related personal data is necessary to ensure safety.
6.2. Data sharing according to legal regulations: Personal data sharing will be performed according to current legal regulations.
6.3. Data processing at the request of state agencies: In emergency cases regarding national defense, national security, social order, disasters, dangerous epidemics; or when there are threats to security and defense that have not reached emergency alert levels; as well as to prevent and combat sabotage, terrorism, crime prevention and other law violations according to legal regulations, personal data processing will be performed at the request of competent state agencies.
6.4. Data processing to fulfill contractual obligations: When providing KChat Products is performed according to contracts between Data Subjects and related agencies, organizations, or individuals, personal data may be processed without separate consent from Users, according to legal regulations.
6.5. Data processing serving state agency activities: Activities of state agencies regulated by specialized laws may require personal data processing without User consent.
7.1. KChat’s security efforts: We continuously strive to protect Users from information security risks. Technically, the KChat Product always integrates advanced security features to ensure Users’ Account Information is stored and processed safely.
7.2. Requirements from Users: Users understand that the level of security also depends on their Device, Internet connection or internal network, as well as factors managed by third parties. Therefore, Users need to proactively take protective measures and accept risks (if any) when using the Product.
7.3. Security commitment: We commit to protecting Users’ privacy and information security according to legal regulations.
8.1. Right to withdraw consent, restrict, object to processing and/or delete personal data: After agreeing to this T&C and during the use of the KChat Product, Users have the right to:
Withdraw consent for personal data processing.
Request restriction or objection to personal data processing.
Request deletion of personal data.
The KChat Product will implement necessary procedures to terminate or restrict personal data processing according to the timeframe, scope, and details requested by Users, provided Users complete all procedures to determine legitimate requests. A request is considered legitimate when meeting the following conditions:
Direct implementation by Users: The request must be implemented by Users themselves without representatives or authorization, except in cases where law requires authorization forms.
User responsibility: Users understand and commit themselves to being responsible for all consequences or damages that may arise from withdrawing consent, or requesting restriction, objection to processing and/or deletion of personal data.
If the request does not fully meet the above conditions, we have the right to refuse implementation. If the request is accepted, the KChat Product will complete necessary procedures within 72 hours from receiving the legitimate request. Note that withdrawing consent or restricting data processing does not affect the legality of data previously processed.
8.2. Right to edit personal data: The KChat Product allows Users to access and edit personal profile data through the user interface.
In cases where direct editing is not possible due to technical limitations or other reasons, Users can send personal data editing requests through request forms to KChat.
After verifying identity and receiving User consent, the Product will implement personal data editing as soon as possible or according to legal regulations. If the request cannot be implemented, the Product will notify Users within 72 hours of receiving the request.
The KChat Product is developed and owned by KChat. All intellectual property rights related to the KChat Product, including but not limited to source code, images, data, information, and other content integrated into the Product; along with modifications, additions, updates, and instruction documents (if any) shall belong exclusively to KChat. No individual or organization is permitted to copy, reproduce, distribute, or perform any form of infringement on these rights without written consent from KChat.
Services provided on the KChat Product are basically free. However, we may deploy some paid services (if any). Fee levels corresponding to each usage package will be announced for Users to choose suitable service packages. In case Users choose to use paid services, service fees will be collected according to Apple Store, Google Play Store, or related digital commerce platform regulations.
Users should regularly check the “Terms & Conditions” page to update the latest terms, ensuring their rights and responsibilities during service use.

In case Users violate any provisions of this T&C, KChat has the right to immediately lock Users’ Accounts. Depending on the nature and severity of violations, Users will be responsible to competent authorities, KChat, and related parties for all damages caused or arising from violations.
14.1. Although KChat makes maximum efforts to maintain the stability of the KChat Product, these efforts may not meet all User expectations. Unless clearly specified in this T&C, whether explicitly or implicitly, KChat does not provide any guarantees, including but not limited to guarantees about stability, security, or accuracy of information that Users receive.
14.2. In all cases, Users agree to exempt KChat from all responsibilities related to any losses, damages, or costs arising from using or being unable to use the KChat Product.
14.3. KChat applies necessary technical, security, and safety measures according to legal regulations to protect Users’ personal information. However, risks related to personal information security, whether through telephone, internet, or other technical means, always exist and no system or security measure is completely safe from all unauthorized intrusion acts. Therefore, in case Users’ personal information is exposed due to hacking or causes beyond the control of KChat, Users agree to exempt all related responsibilities for KChat.
14.4. Within the scope permitted by current law, Users agree to compensate KChat for all litigation procedures, legal responsibilities, and costs arising from third-party complaints related to Product use or T&C violations.
14.5. Before implementing and completing procedures to exercise Data Subject rights, Users are responsible for researching, understanding clearly, and recognizing legal consequences, responsibilities, and rights that may arise when exercising Data Subject rights. Withdrawing consent, requesting restriction, or deletion of personal data may lead to legal consequences and/or damages that the KChat Product may have to bear, including but not limited to:
Legal violations if continuing to exercise Data Subject rights;
Contract or personal data processing T&C violations signed with third parties;
Economic damages arising from legal or contract violations.
If KChat assesses that Data Subject requests may lead to legal consequences or damages mentioned above, the company has the right to consider and unilaterally decide to refuse implementing such requests.
When necessary, KChat has the right to modify, update, or adjust the contents of this T&C at any time. The latest version will be posted on the KChat Product, and Users commit to checking the “Terms & Conditions” section to always update the current version.
